05/ 09.04.2026: Heard, learned counsel for the parties.

2. It is the grievance of the petitioners that the boundary wall of the petitioners is sought to be demolished treating it to be construction over encroached Government land.

3. Mr. Indrajit Sinha, learned counsel appearing on behalf of the petitioners submits that petitioner has purchased the property and land in question and thereafter bounded the property by putting up a boundary wall. The boundary wall is well within the purchased area of the petitioners, but in absence of the petitioners, the respondents have affixed the notices and now are bent upon to demolish the same as the respondents have stated that they will demolished on 10th April, 2026 i.e. tomorrow.

4. Considering the said submission, I direct the Circle Officer, Baghmara, Dhanbad along with a duly qualified Amin to measure the land of the petitioners which is covered with the sale deed and thereafter, if it is found that any portion of the boundary wall is beyond the area covered in the sale deed, the respondents will only demolish that portion.

5. The entire measurement should be done in presence of the petitioner and the petitioner will remain present tomorrow or any other date fixed by the Circle Officer. If the process is not carried out tomorrow i.e. 10th April, 2026, prior notice informing the date should be intimated to the petitioners for measurement.

6. List this case after four weeks.

7. Let a copy of this order be handed over to the learned counsel for the State and learned counsel for the petitioners.
