1. Heard the learned counsel appearing on behalf of the parties.

2. This appeal has been filed against the judgment and order dated 25.09.2008 passed by learned 5th Additional Sessions Judge (F.T.C), Jamtara in Sessions Trial No. 06 of 2006 by which the appellants have been held guilty for the offence punishable under Sections 323, 325 read with Section 149 and under Section 147 of the Indian Penal Code and they have been convicted and directed to be released on probation of good conduct and sentence at once is being was adjourned to all the convicts are directed to be released by entering a bond of Rs.10,000/- without sureties to appear and receive the same when called upon during the period of two years from the date of the judgment and in the meantime they were directed to maintain peace and be of good behavior.

3. Learned counsel for the appellants has submitted that apparently no sentence has been imposed and the appellants have been

released on bond. Learned counsel for the appellants submitted that he does not want to press this appeal.

4. Learned counsel for the State has no objection with regard to the prayer made by the learned counsel for the appellants.

5. Accordingly, this appeal has been dismissed as not pressed.
