Heard the parties.

Learned counsel for the appellants submits that this interlocutory application has been filed with the prayer to suspend the sentence of the appellants as imposed vide the judgment of conviction dated 19.01.2026 and the order of sentence dated 19.01.2026 passed by the learned Sessions Judge, Pakur in connection with S.T. No. 164 of 2022 and to enlarge the above named appellants on bail. Learned counsel for the appellants submits that the appellants have been convicted and sentenced as under:-

Learned counsel for the appellants further submits that it has also been ordered that all the sentences shall run concurrently. It is then submitted that during the pendency of the trial, the appellant No.1, 2 and 4 were in custody from 02.12.2020 to 18.12.2020 and the appellant No.3 was in custody from 08.02.2022 to 07.03.2022. It is then submitted that the appellants have very good grounds to agitate in this appeal and unless the sentence of the appellants is suspended during the pendency of the appeal, they will be highly prejudiced. It is further submitted that there is no likelihood of this appeal being disposed of in the near future. It is lastly submitted that the appellants undertake to co-operate with the hearing of this appeal. Hence, it is submitted that the appellants be enlarged on bail.

Learned counsel for the respondent No.2 opposes the prayer for bail of the appellants.

Considering the aforesaid facts of the case, it is ordered that the impugned sentence of the appellants as imposed upon them vide the judgment of conviction and the order of sentence both dated 19.01.2026 passed by the learned Sessions Judge, Pakur in connection with S.T. No. 164 of 2022 shall remain suspended till disposal of this appeal, on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Pakur in connection with S.T. No. 164 of 2022 with the condition that he will co-operate with the hearing of this appeal.

Accordingly, this Interlocutory Application is allowed.
