04/ 12.09.2025. The instant Misc. Appeal has been filed by the claimants/ appellants for the enhancement of compensation awarded in judgment in Motor Accident Claim Case No.400 of 2022 whereby and whereunder a compensation of Rs.1,05,80,000/- has been awarded in favour of the claimants under Section 166 of the M. V. Act.
The deceased was a Government servant and the learned Tribunal awarded the compensation by considering the pay slip (Ext.14) and according to which his monthly income was Rs.93,156/-. He left behind four dependents, therefore, 1/4th has been deducted on the personal and living expense of the deceased.
Learned counsel for the appellants/ claimants has failed to raise any point so as to show infirmity in assessment of income and award of compensation.
Under the circumstances, I do not find any infirmity in the impugned order/ judgment passed by the learned Tribunal.
