            Heard the parties.

This Interlocutory Application has been filed on behalf of the appellant for suspension of sentence during the pendency of this criminal appeal.

The appellant has been filed this application against the judgment of conviction dated 08.08.2023 and order of sentence dated 11.08.2023, passed by Mr. Dinesh Rai, learned Additional Judicial Commissioner-I, Ranchi, in connection with S.T. Case No.263 of 2027, arising out of Kotwali P.S. Case No.1015 of 2012, corresponding to G.R. Case No.5597 of 2012 for offences under Sections 25(1-A)/ 35 and 26(2)/ 35 of the Arms Act and Section 414/34 of the IPC and was held guilty under Section 25(1- A)/35 of the Arms Act and thereby sentencing him to undergo R.I. for six years for the offences under Section 25(1-A)/35 of the Arms Act along with fine of Rs.10,000/- in default of payment of fine to undergo S.I. for three months. The appellant was further sentenced to undergo R.I. for six years along with a fine of Rs.10,000/- for offence under Section 26(2)/35 of the Arms Act and in default of payment of fine to undergo S.I. for three months.

Learned counsel for the appellant submitted that the appellant has remained in custody for about three years. He has served nearly half of the sentence.

Considering the period of custody and the fact that this criminal appeal is not likely to be taken up for hearing in near future, I am inclined to release the appellant, on bail. Accordingly, the appellant, named above, is directed to be released on bail, during the pendency of this appeal, on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of Mr. Dinesh Rai,

learned Additional Judicial Commissioner-I, Ranchi or his successor, in connection with S.T. Case No.263 of 2027, arising out of Kotwali P.S. Case No.1015 of 2012, corresponding to G.R. Case No.5597 of 2012.

The aforesaid I.A. stands allowed and disposed of.
