Order No.05/13.11.2025 I.A. No.14802 of 2025

1. Heard both the sides.

2. The I.A. No.14802 of 2025 has been filed on behalf of the appellant for ignoring the defects pointed out by the stamp reporter.

3. In view of the averments made in I.A. No.14802 of 2025 at Paragraph Nos.1,3,4,5 and 6, the defects, as pointed by the stamp reporter is ignored.

4. Thus, the I.A. No.14802 of 2025 is allowed and stand disposed of.

5. Learned A.P.P. is directed to get served notice of this Criminal Appeal upon the victim girl "X" through the Superintendent of Police, Dumka, in light of the judgment rendered in the case of Nipun Saxena and Anr. Versus Union of India reported in (2019) 2 SCC 703 and Notification No.23/2023/R&S/JHC dated 20.12.2023 of the Jharkhand High Court and shall file an affidavit with regard to service of notice upon the victim girl "X" and also directed to produce the neatly typed copy of the case diary.

6. Call for the neatly typed copy of the case diary and statement of victim girl X recorded under Section 183 of BNSS and medical report of the victim girl X.

7. The learned APP shall ensure production of neatly typed copy of the case diary, failing which action will be taken against the Police Official.

8. Put up this case after four (04) weeks.

9. Let a copy of this order be sent to the Office of Superintendent of Police, Dumka by FAX and be also handed over to the learned A.P.P for the needful.
