Order No: 03/ Dated: 05.05.2025 This Criminal Appeal has been filed on behalf of the appellant by challenging the judgment of conviction and order of sentence dated 22.02.2005 passed by learned Special Judge, POCSO in Special Pocso Case No. 57 of 2023 arising out of Kunda P.S Case No. 129 of 2023 by which the appellant has been convicted for the offence under Sections 354-D and 506 of the I.P.C and sentenced to undergo R.I for two (02) years under Section 354-D of the I.P.C and to pay the fine of Rs. 5,000/- and R.I for one (01) year under Section 506 of the I.P.C and to pay the fine of Rs. 3,000/-.

2. I.A (Cr.) No. 3330 of 2025 has been filed on behalf of the petitioner for confirmation of the provisional bail granted to the appellant till 24.03.2025 vide order dated 22.02.2025.

3. It appears that vide order dated 28.03.2025 this Court had issued notice upon the guardian of victim girl and had extended the Provisional Bail of the appellant till 05.05.2025.

4. Learned counsel for the State has submitted that his counter affidavit is ready and notice has been served upon the

guardian of victim girl in the light of order dated 28.03.2025 and he will file the counter affidavit by tomorrow.

5. Under the circumstances, the Provisional Bail of the appellant is, hereby, confirmed.

6. Thus, I.A (Cr.) No. 3330 of 2025 is allowed and stands disposed of.
