2. Mr. Rajneesh Vardhan, learned APP waives notice on behalf of the State.

The instant interlocutory application has been filed on behalf of the appellants for confirmation of provisional bail granted to the appellants by the learned trial Court vide order dated 18.02.2025 in Sessions Trial No. 40 of 2017 arising out of Garhwa P.S. Case No. 412 of 2016 corresponding to G.R. Case No. 1839 of 2016 during the pendency of the instant criminal appeal which has been preferred against the judgment of conviction dated and order of sentence dated 18.02.2025 passed by learned Sessions Judge, Garhwa whereby and whereunder appellants have been convicted under Sections 324/149 of IPC and sentenced to undergo R.I. for two years with a fine of Rs.5,000/- each to be paid to injured/victims in equal proportion and in default of payment of fine, further directed to undergo imprisonment for four months.

It has been submitted on behalf of the appellants that the learned trial Court after recording the judgment of conviction and order of sentence, granted the provisional bail to the appellants vide order dated 18.02.2025 for a period of 30 days in order to facilitate the appellants to prefer an appeal before this Court. It has also been pointed out that the maximum sentenced awarded to the appellants is two years along with a fine of Rs. 5,000/- for the offence punishable under Section 324/149 of the IPC and in this view of matter, it is prayed on behalf of the appellants that let the provisional bail granted to the appellants be confirmed.

6. Learned APP appearing on behalf of the State does not raise any objection.

7. Having heard the learned counsel for the parties.

8. In view of the submissions advanced on behalf of the learned counsel appearing on behalf of the appellants, the provisional bail granted to the appellants is hereby confirmed.

9. Accordingly, the instant I.A. No.2580 of 2025 is allowed and as such disposed of.
