Heard the parties.

2. This anticipatory bail application under Sections 482 and

484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023,

has been preferred by the petitioner apprehending his arrest for

offences registered under Sections 420 of the Indian Penal

Code pending in the court of JMFC, Dhanbad in connection with

C.P. Case No. 1581 of 2018.

3. The case arises of a complaint and the petitioner has

rushed to this Court on issuance of summons. Admittedly no

warrant has been issued. The offence alleged is punishable

under section 420 of the Indian Penal Code which is punishable

for less than seven years and more so, cognizance has been

taken in this case.

4. Learned A.P.P. representing the State opposes the prayer

for anticipatory bail.

5. Since the case arises of complaint there is no question of

investigation. Thus, I direct the petitioner to appear before the

court concerned.

6. Once the petitioner appears before the court concerned,

the concerned court will pass an appropriate order in terms of

the judgment passed by the Hon'ble Supreme Court in the case

of "Satender Kumar Antil vs. CBI and Anr." reported in

(2022) 10 SCC 51 .

7. Accordingly, this Anticipatory Bail Application stands

disposed of.
