04/03.07.2025: Counsel for the petitioners seeks permission to withdraw this application so far
as petitioner No. 3 is concerned, as petitioner No. 3 has not been named in the charge- sheet and he has been exonerated.
Permission, as sought for, is accorded.
Accordingly, this application is dismissed as withdrawn, so far as petition No. 3 is concerned.
Now this application is confined only with respect to petitioner Nos. 1 and 2 only. This anticipatory bail application under Section(s) 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioners apprehending their arrest for offences registered under Section(s) 147, 148, 149, 341, 323, 324, 325, 307, 504 and 506 IPC and Sections 3/4 of the SC/ST Act, now pending in the Court of Addl. Sessions Judge-I-cum-Special Judge, SC/ST Act, Garhwa.
Learned A.P.P opposes the prayer for anticipatory bail. Since the chargesheet has been submitted and cognizance has already been taken in this case, there is no apprehension that the petitioners will be arrested, I direct the petitioners to appear before the Court concerned and file necessary bonds to the satisfaction of the Court. Once the petitioners appear, the Court will pass an appropriate order in view of the Judgment passed by the Hon'ble Supreme Court in the case of Satender Kumar Antil Vs. Central Bureau of Investigation & Another, reported in (2022) 10 SCC 51 as well as the observation made in the case of Satender Kumar Antil Vs. Central Bureau of Investigation & Another reported in (2021) 10 SCC 773, and file necessary bonds to the satisfaction of the Court.
Accordingly, this application stands disposed of.
