10/06.01.2025 Learned counsel for the appellants is present. He submits that I.A. No. 9876 of 2024 has been filed seeking condonation of delay of 1620 days in filing the present First Appeal.

2. The learned counsel for the appellants further submits that earlier one appeal being First Appeal No. 13 of 2018 was filed which stood dismissed for default/non-prosecution on 17.05.2019 by this Court and instead of filing any petition for restoration of the said First Appeal, the present First Appeal has been filed.

3. Learned counsel for the appellants is directed to advance arguments as to how the present First Appeal is maintainable once the First Appeal No. 13 of 2018 has been dismissed for non-prosecution.

4. Learned counsel for the appellants prays that the matter be posted on 28th January 2025.

5. Post this case on 28th January 2025 in the supplementary cause- list.

6. The learned counsel for the appellants shall file the judgments which he seeks to rely upon by 24th January 2025.

7. Office is directed to place the records of First Appeal No. 13 of 2018 along with the present records.
