03/02.01.2025 The office has pointed out that this application is not maintainable because this application is directed against the order of acquittal passed by the Court of learned District & Additional Sessions Judge-II, F.T.C. (C.A.W.), Bermo at Tenughat in Criminal Appeal No. 07/2021.
The Hon'ble Supreme Court has already held in the Case of "Joseph Stephen & Ors. Vrs. Santhanasamy & Ors." as reported in [AIR 2022 SC 670] that appeal against acquittal by judgment passed by the Appellate sessions Court will lie before the High Court.
In view of this fact, this Acquittal Appeal will be maintainable. The Office is directed to give fresh stamp reporting.
