1. It appears that the present civil revision application has been filed against the order dated 21.11.2022, passed by the court of learned Civil Judge (Senior Division) -X, Dhanbad in Misc. Civil Application No.461 of 2022, arising out of Execution Case No.08 of 1997, whereby the application under Section 47 of the Code of Civil Procedure, filed on behalf of the judgment debtor/ petitioner, has been dismissed.

The aforesaid execution case has arisen from the judgment and decree dated 26.04.1997, passed in Title Suit No.184 of 1969.

2. It further appears that the plaintiff has won the case and as such an appeal has been preferred being Title Appeal No.12 of 1997 by the respondents. The said appeal has been disposed of by the judgment dated 24.05.2003 and the decree has been drawn on 21.06.2003.

3. It further appears that the first appellate order has been challenged by the original defendants by filing second appeal being Second Appeal No.387 of 2003, which is still pending before the co-ordinate Bench of this Court.

4. In view of above factual matrix and the pending litigation, it is desirable that the Second Appeal No.387 of 2003 and the present Civil Revision No.7 of 2023 should be heard by the same Bench. Accordingly, let the present Civil Revision No.7 of 2023 be placed before the appropriate Bench after taking due permission from Hon'ble the Chief Justice.
