1. On 20.11.2025 this Court passed the following orders:-

"On 22nd August, 2025, the Court passed the following orders:-

1) Water, water, everywhere, but not a drop to drink" - this line, originally from Samuel Taylor Coleridge's The Rime of the Ancient Mariner, seems to aptly describe the current state of Rajendra Institute of Medical Sciences (RIMS) in Ranchi, a supposed premier hospital in the region.

2) Despite being one of the leading medical institutions in Jharkhand, RIMS is facing an

unfortunate decline in both infrastructure and basic amenities. The hospital, intended to provide top-tier healthcare to the masses, is grappling with issues that question its ability to function effectively.

Among the most concerning problems is the severe lack of clean and safe drinking water, a fundamental necessity for any medical facility. Despite the abundance of water around, such as in tanks or pipes, there is often no access to potable water for patients and staff alike. This not only puts the health of individuals at risk but also reflects poorly on the hospital's capacity to maintain hygienic standards.

3) The situation is further compounded by inadequate sanitation and dilapidated infrastructure. Hospital wards, once expected to be pristine environments for healing, are often plagued by leaking roofs, malfunctioning air conditioning, broken equipment, and poor ventilation. The overcrowding in certain wards adds to the discomfort, making it difficult for patients to receive proper care.

4) Medical staff, although dedicated, are often left to contend with a lack of necessary resources, such as medicines, equipment, and diagnostic tools, hindering their ability to perform at their best. This compromises the quality of patient care and impacts the efficiency of medical procedures.

5) The leadership at RIMS has come under scrutiny for its failure to address these issues, despite the growing demands for high-quality healthcare in Jharkhand. While the State Government has occasionally promised reforms and upgrades, the reality on the ground tells a different story. The hospital, which should serve as a model for healthcare institutions, continues to fall

short in meeting the expectations of both the people and the medical community.

6) In conclusion, the poor condition of RIMS stands as a stark reminder of the urgent need for both infrastructural and administrative reforms. Until such changes are made, the hospital's reputation as a "premier institution" will remain more of a distant ideal than a current reality.

7) We have heard the matter for a fairly long time and are of the considered view that immediate intervention is required in the proper functioning of the RIMS.

8) Certain proposals for improvement of RIMS have been set out in the supplementary affidavit filed by the Additional Law Officer, RIMS.

9) We find those proposals to be meaningful.

10) In addition thereto, certain proposals have been given by the Committee that has inspected RIMS on the directions of this Court.

11) In addition thereto, certain vacancy positions have also been set out in a tabular form which are required to be filled up immediately.

12) Let all these documents, referred to above, along with the important orders passed by this Court from time to time in W.P. (PIL) No.1301 of 2020, W.P. (PIL) No.4736 of 2018 and W.P. (C) No.2399 of 2019, be circulated amongst the Members constituting the Governing Body by the Secretary (Health), so that they could be deliberated upon in the next meeting of the Governing Body. For this purpose, let three copies be prepared by the Registry out of which one copy be handed over to the office of Advocate General, who, in turn, shall hand over the same to the Secretary (Health) and two copies be retained for record.

13) Let a meeting(s) be convened by the Governing Body between 8th to 14th of September 2025.

14) In the meanwhile, RIMS is directed to ensure that the tests for which facilities are available in- house in the RIMS itself are not sent outside of RIMS to any private laboratory.

15) In addition thereto, the Director, RIMS as well as the Secretary, Health Department, Govt. of Jharkhand, shall ensure that no Doctor posted in the RIMS is permitted to carry out private practice, given the fact that these doctors are getting non- practicing allowances, and also because an order to this effect already stands passed on 2nd of September 2022 and yet, this practice has gone unabated and unnoticed.

16) Hon'ble Mr. Justice Amareshwar Sahay, a retired Judge of this Court, is appointed as an Observer of the meeting(s) of the Governing Body.

17) List on 19.09.2025, by which time minutes of the meeting be placed for perusal of this Court.

18) The RIMS as well as the Secretary, Health, shall apprise this Court about the audits that have been conducted after the establishment of the RIMS and consequential actions taken on the objections (if any), on the next date of hearing."

2. This was followed by the order dated 19th September,

2025, which is as under:-

"1. Affidavit in terms of the order dated 22.08.2025 has not been filed by the State.

2. Let the needful be done within one week.

3. Since the meeting, in terms of order dated 22.08.2025, has been fixed on 9th October, 2025, we deem it appropriate to defer these proceedings.

4. Hon'ble Mr. Justice Amareshwar Sahay, retired Judge of this Court, has requested to act as an Observer of the next meeting also.

5. The State is directed to make all arrangements for the Observer so as to facilitate his presence in the next meeting.

6. The agenda of the next meeting be supplied to all the stakeholders well in advance including the Observer.

7. The next meeting, which is scheduled to be convened on 9th October, 2025, shall include the direction contained in paragraph-14 of the order dated 22.08.2025 in the agenda.

8. List on 10th October, 2025.

3. Lastly, a very detailed order was passed by this Court

on 10th October, 2025, which reads as under:-

1. "Reference be made to the order dated 19.09.2025.

2. Mr. Rajendra Krishna, party-in-person, has submitted that the buildings is in very worst condition and any time it may collapse. He has further submitted that the recruitment process is also very slow. However, as per the affidavit filed on behalf of the RIMS and the State, the discussion has been made and approval has been granted and, as such, the need is to conclude the decision so taken in the last meeting of the Governing Body.

3. Learned counsel appearing for the respondent-State as also the respondent-RIMS have jointly submitted by referring to the counter affidavit filed on their behalf regarding the deliberation made in the Governing Body meeting held on 13.09.2025 under the observation of Hon'ble Mr. Justice Amareshwar Sahay, former Judge of this Court, that different agendas were discussed i.e., with respect to appointment on

vacant post, creation of new posts, purchase of machinery, equipment, and other supplies, construction of new building and renovation of old buildings at RIMS, address the problem of drinking water supply and water logging within the RIMS campus, comprehensive improvement in patient welfare at the trauma center and central emergency center, proposal to prohibit private practice by doctors working at RIMS, implement mandatory attendance system to ensure attendance at work by doctors and staff working at RIMS, proposal to form a committee/Advisory Board of specialist doctors from renowned medical institutions in the country to provide advice on improving the system at RIMS, proposals made in the inspection report of the Advocates Committee constituted by the High Court in W.P.(PIL) No.4736 of 2018, directions given by the High Court in W.P.(PIL) No.1301 of 2020 and to brief the members on the compliance report of the audit reports of various financial years, and decision has also been taken.

4. We, after going through the said agendas, have found that the decision although has been taken, but without any time frame.

5. We are of the view that time is the essence, reason being that we are dealing with the issue of medical aid to be provided to the citizens of the State of Jharkhand as per the fundamental right conferred to them under Article 21 of the Constitution of India.

6. Further, for the reason that the decision although has been taken agenda wise but in absence of the time frame, the purpose for which the present Public Interest Litigation has been filed to look into the medical issues of the people of Jharkhand will be frustrated. Therefore, this Court

7. From perusal of the affidavits filed on behalf of the State and the RIMS it is evident that no reference of the internal mechanism of the pathological tests has been made even though we have passed specific direction and in one of the earlier affidavits, having been placed by the learned Advocate General, it has been stated therein that the mechanism for pathological tests including the X-ray, CT Scan etc. is being considered to be done internally. But in the instant affidavit, there is no reference regarding that decision.

8. Let the Director, RIMS file specific affidavit with respect to the pathological tests which is to be done by way of internal mechanism so that the poor people may not be compelled to go to the private pathology labs.

9. The details of the Pradhan Mantri Bhartiya Janaushadhi Kendra in the RIMS Campus which has been revived on the basis of the order passed by this Court, be also furnished pertaining to its functioning along with availability of the medicines.

10. It needs to refer herein by making reference of the order dated 27.05.2021 in pursuance thereto and for the purpose of revamping the cardiology department of the RIMS, certain Cath Labs have been purchased, i.e., Single Plane Cath and Bi- Plane Cath, along with CT Angiography machine. Let specific affidavit be filed regarding the functioning of the Cardiology Department including the technical manpower having acumen in CT Angiography.

11. Learned counsel for the respondent-State and respondent-RIMS have submitted that another meeting of the Governing Council has been held on 09.10.2025. The report on the basis of the deliberation so made in the meeting needs to be brought on record, therefore, they have sought for time.

12. The respondents are directed to place on record the Minutes of the meeting that was held on 9th October, 2025 pursuant to the order passed by this Court.

13. Let the next meeting be also convened under the observation of the Observer and the report be submitted on or before the next date of hearing.

4. In compliance to the order passed by the Court on 10th

October, 2025, the respondent-RIMS has filed its affidavit

and it shall be apt to reproduce paragraph 5 thereof which

reads as under:-

"5. That following is present status and action taken with respect to the direction and queries of Hon'ble court:-

A. With regards to the direction of Hon'ble court in Sl. 6 of the interim orders dated 10/10/2025, it is stated that the above interim order will be placed in next G.B. Of RIMS which is scheduled on 12/11/2025 and all efforts will be taken by RIMS to comply with directions passed in sl no 6 of interim order dated 10/10/2025 within the time limit. However so far compliance of sl no 6 (7) is concerned, Jharkhand state Building construction corporation ltd (JSBCCL) is the concerned agency to comply with the same.

B. With regard to sl no. 7 of interim order, it is stated that currently all radiological tests are performed in-house in RIMS with exception of MRI and Mammography.It is stated that newly purchased MRI is currently being installed and likely to be functional within 1 month. With regards to mammography, it is stated that tender for purchase of mammography has been finalised and work order will be issued within one month. Additonally RIMS has also initiated process for purchase of High end diagnostic equipment such as PET Scan and Portable CT Scan.

C. In reply to serial no. 8 of interim order, it is stated that central lab is functional in RIMS and all the common pathological, microbiological, biochemistry and immune screening tests are done in house. However there is need to upgrade the

machines to meet the requirement of high patient load. Tender for purchase of above machines will be floated within 1 months. Some high end tests like immune profiling tests are not done currently. Tender for procurement of reagents for these tests will be floated soon and attempts will be made to start these tests within 6 months. (Ref: Annexure 1) D. In reply to sl no 9 of interim order, it is stated that Pradhan mantri jan aushadhi kendra is fully functional and maintains adequate stock of medicines and surgical consumables. Currently the above kendra has stock of around 750 medicines and consumable items.(Ref: Annexure 2) E. In reply to s1. no 10 of interim order, it is stated that currently there are two cath labs in cardiology dept, RIMS and both are functional. There is deficiency of 3 cath lab technician for which recruitment will be initiated soon as per decision of Governing Body, RIMS. CT angiography is currently performed by Dept. of Radiology, RIMS and this facility is available both in Dept. of Radiology and Trauma Centre where the CT Machines are installed. (Ref: Annexure 3) F. In reply to serial no. 11 of the interim order, the following are the minutes of meeting of Governing Body, RIMS dated 10/10/2025:

Confirmation and Compliance Report of the Proceedings of the 59th Meeting of the Governing Body, RIMS, Ranchi. Decision - The proceedings of the 59th meeting of the Governing body, dated 15.04.2025 was confirmed with the following instructions: 59.2(i) - The complete details related to the appointments done recently were directed to be presented before the Chairman of the Governing Body.

59.2 (ii) - The Hon'ble members were informed of the action being taken at the RIMS level on EPF deductions and a decision was taken to take appropriate action.

59.7-Instructions were given to correspond with the Director of Audit, Finance Department, Government of Jharkhand to resolve the pending payments related to bills submitted by agencies outsources for diagnostic tests conducted on PPP mode.

59.11- Instructions were given to purchase five air-conditioned Moksha vehicles within two months to transport the bodies of deceased patients from RIMS to their homes free of charge. 59.13- Instructions were given to take legal/appropriate steps for regularisation of employees working for more than 10 years. 59.14-Instructions were given to prepare a clear and complete report (which should include comparative/factual description of the rules and salaries of the State Government and AIIMS) regarding the appointment-promotion rules and pay fixation of the GDMO/MO, and to present the report/proposal to the next Governing Body 59.16- In view of the shortage of specialists, a time limit of 6 months was set for completing the tender process for the operation of the equipment required for diagnostic testing, Pet CT and Thallium Scan in PPP mode.

59.19- The State Government directed that instead of earmarking the plan budget amount for any particular equipment in the budget allocation, the priority for purchasing equipment as per the requirement of all the departments of RIMS should be determined at the RIMS level and the purchase should be made after obtaining approval from the Standing Finance and Accounts

Committee/Governing Body.

59.25- The appointment process for the regular Principal of RIMS Dental Institute was directed to be completed as soon as possible.

59.38.5- In order to provide more and free medical facilities to poor patients, RIMS was directed to provide all types of medicines, implants, and diagnostic procedures, etc., completely free of charge, to Ayushman/Abua card/ insurance holders within the amount prescribed by the card. It was decided to prohibit these cardholders from issuing prescriptions for medicines and surgical implants from outside. The Governing Body expressed concern over the shortcomings in the facilities provided by RIMS to these cardholders. Dissatisfaction was also expressed over the reduction in the Ayushman Bharat claim amount this year compared to last year and decision was taken to make efforts to increase this amount. It was also directed to prepare a monthly report on the claim amount.

59.38.6- It was informed that a new tender has been issued for installation and maintainance of the firefighting system in four buildings located at RIMS. Instructions were given to conduct an audit of the fire fighting system at RIMS by the State Fire Service.

Agenda No: 2 Confirmation and discussion of Agenda No. 1 of the proceedings of the 60th meeting of G.B. held through circulation, regarding the clarification sought from RIMS Director Dr. Rajkumar by the Hon'ble Minister- cum-Chairman, Governing Body, RIMS, Ranchi.

Decision - The General body approved the clarification sought from RIMS Director Dr. Rajkumar by The Hon'ble Minister- cum-

Chairman, Governing Council, RIMS, Ranchi. Agenda 1 of the proceedings of the 60th meeting, held through circulation, was not discussed.

Discussion and decision on the response received from RIMS Director Dr. Rajkumar in light of the clarification sought from him.

Decision - The above agenda was not discussed.

Establishment and operation of the Regional Eye Institute under RIMS, Ranchi.

Decision - It was informed that 103 new posts have been created for the Regional Eye Institute. After including the previously approved posts and getting the roster clearance from the government level, approval was given to publish the advertisement. Also, considering the utility of the 114 bed capacity in the new Regional Eye Institute building, it was decided to allocate space to the Eye Department as well as the ENT department as per requirement. After the current Eye Department and ENT department are shifted to the new Regional Eye Institute building and considering the patient load, it was decided to allocate the old site to the Neurosurgery Department or any other department as per requirement on the recommendation of the Estate Committee.

Discussion and decision on coaching arrangements for NEET candidates at RIMS, Ranchi.

Decision - After consideration, it was decided to arrange coaching for a maximum of 30 students at RIMS for NEET preparation. A Nodal officer will be designated for this purpose and a classroom site has to be identified for this purpose. A panel will be formed by receiving applications from

interested and meritorious first- and second-year RIMS students to provide coaching. Students from the panel will be paid 2,500 per hour, and each student will be allowed to conduct a maximum of four classes per week. Senior faculty members/physicians at RIMS will have no involvement in this work.

Disciplinary action against the erring official/public relations officer of the Rajendra Institute of Medical Sciences.

Decision - After consideration, the currently designated public relation officer was directed to be immediately removed from his position. It was also decided that the Public Relations Officer be served a show-cause notice and the response received be presented at the next Governing Body meeting.

Discussion and Decision on the Panel of Advocates Nominated for the Rajendra Institute of Medical Sciences.

Decision - After consideration, it was decided to cancel the currently active panel of nominated advocates for RIMS and directed that advertisements be invited for a new panel by the first week of November, in accordance with the Law Department's guidelines. A report to determine the new panel was directed to be presented at the next Governing Body meeting. Until this process is completed, the judicial work of RIMS will be performed by the current panel.

Confirmation of all the various standing and ad- hoc committees of RIMS.

Decision - After consideration, the proceedings of the 11th meeting of the RIMS Standing Finance

and Accounts Committee dated 20.09.2024, 12th meeting dated 27.01.2025, and 13th meeting dated 13.09.2025 were approved. It was also decided that the proceedings of the meetings of the standing and ad- hoc committees constituted in accordance with the provisions of the RIMS Rules and Regulations should be presented before the Governing Body for confirmation only with regards to financial matters. The remaining standing and ad-hoc committees have the authority to take decisions in accordance with the provisions contained in the RIMS Rules 2002 and RIMS Regulations 2014.

Decision regarding the increase in the amount of the Interns Stipend at RIMS.

Decision - The stipend currently payable to MBBS and BDS interns at RIMS was increased to 30,070 per month from 26,300 per month.

Decision on the single successful agency received in light of three tenders for the execution of the Institute's biomedical waste management program.

Decision - After consideration, it was decided to grant a one-month extension to the agency currently working for biomedical waste disposal at RIMS at the same rates and conditions. It was also directed that an evaluation report of the agency's work be obtained and presented at the next Governing Body meeting.

Regarding the approval of the revised wages and variable allowances as per the notification of the Labor Department, Government of Jharkhand, for the manpower provided by an outsourcing agency at RIMS, Ranchi.

Decision - After consideration, the payment of the revised wages and variable allowances as per the notification of the Labor Department, Government of Jharkhand, for the manpower provided by the outsourcing agency was, approved. It was also directed that the biometric attendance and monthly payment details of the personnel employed by the outsourcing agency be matched with the bank statements to ensure that the payments are being made only to the personnel employed by the agency.

Regarding the payment of outstanding dues to Home Guards posted at RIMS, Ranchi, as a result of increasing their duty allowance from Rs. 500/- (five hundred) and food allowance from Rs. 50/- (fifty) to a lump sum of Rs. 1088/- (one thousand eighty) per day, effective 10.08.2024 in compliance with Resolution No. 4596 dated 10.08.2024 of the Home Prison and Disaster Management Department.

Decision - After consideration, approval was given to pay the outstanding dues to Home Guards posted at RIMS, Ranchi, effective 10.08.2024, in compliance with Resolution No. 4596 dated 10.08.2024 of the Home Prison and Disaster Management Department.

Discussion and decision regarding the leave of the Director, RIMS, Ranchi.

Decision - The above proposal was not discussed.

of the Standing Finance and Accounts Committee meeting dated 18.09.2025. Decision - After consideration, it was decided to proceed with contracts/tenders of 1.00 crore or

above after the approval of the Standing Finance and Accounts Committee, as per the provisions contained in the RIMS Rules, 2002. It was also decided to amend Clause 6.5 (b) (c) of the RIMS Regulations, 2014 in light of the above decision and to submit the revised proposal to the Health Department.

In light of the investigation report submitted by the Enquiry Officer, Dr. Pradeep Kumar Bhattacharya, in the ongoing departmental proceedings against Dr. Anshul Kumar, Associate Professor, Department of CTVS, RIMS, Ranchi, proposal to exonerate Dr. Anshul Kumar, Associate Professor, Department of Clinical Medicine, RIMS, Ranchi, from all charges.

Decision - Based on the investigation report, after consideration, it was decided to exonerate Dr. Anshul Kumar, Associate Professor, Department of Clinical Medicine, RIMS, Ranchi, from all charges.

Decision on the proposal to create 30 posts of Medical Record Technician (MRT) in the Central Medical Records Department and Training Centre, RIMS, Ranchi.

Decision - After consideration, approval was given for the creation of 30 posts of Medical Records Technician (DTS) in the Central Medical Records Department and Training Centre, RIMS, Ranchi.

Discussion and decision on e-tender No. 72 (C) dated 05.10.2024 for operation of the kitchen for the institute.

Decision: After consideration, approval was given for an extension to the existing agency at the pre-

determined rates and terms until the final judgment is passed in the case filed in the Hon'ble Jharkhand High Court or for the next one month (whichever is earlier).

Decision on the proposal for amendment to the Rajendra Institute of Medical Sciences, Ranchi, Appointment, Promotion, Service Conditions and Rules for Paramedical Personnel, 2015. Decision - After consideration, the proposal for amendment to the RIMS, Ranchi Paramedical Personnel Appointment, Promotion, Service Conditions and Rules 2015 was approved and it was decided to conduct the recruitment process through written examination. It was decided to conduct the written examination for recruitment through the Jharkhand Staff Selection Commission or an authorized agency of any PSU under Government of India.

Proposal to amend the Rajendra Institute of Medical Sciences, Ranchi, Nursing Cadre Appointment, Promotion and Service Conditions Rules, 2014 for the Nursing Cadre.

Decision - After consideration, the proposal to amend the RIMS, Ranchi Nursing Cadre Appointment, Promotion and Service Conditions Rules, 2014 was approved and it was decided to conduct the recruitment process through written examination. It was decided to conduct the written examination for recruitment through the Jharkhand Staff Selection Commission. or an authorized agency of any PSU under Government of India.

Decision on the proposal to amend Clause 4(xii) of the RIMS Regulations, 2014.

Decision - After consideration, it was decided to conduct the roster clearance for Grade 1 and Grade 2 employees under RIMS, Ranchi through the Department of Personnel, Administrative Reforms and Rajbhasa, Government of Jharkhand. Additionally, a proposal was approved to constitute a four-member committee under the chairmanship of the Director, RIMS, for roster clearance of Grade 3 and Grade 4.

The committee will be constituted as follows:

1. Director, RIMS - Chairman.

2. Administrative Officer, RIMS-

Member.

3. Principal Secretary/ Additional Chief Secretary - Member. Representative of the Department of Health, Education and Pharmaceuticals, Government of Jharkhand, nominated by the Health Department.

Member. Representative of the Department of Personnel, Government of Jharkhand, nominated by the Personnel, Administrative Reforms and Rajbhasa.

Decision on approval to carry out various repair, renovation, and annual maintenance works related to the Building Construction Department, Drinking Water and Sanitation Department, and Electrical Works Department under RIMS, Ranchi from the funds available under the Establishment Expenses (Non-Salary) head. Decision - After consideration, it was decided to carry out various repair, renovation, and annual maintenance works related to the Building Construction Department, Drinking Water and

Sanitation Department, and Electrical Works Department from the funds available under the Non Plan (Non- Salary) head.

Decision for determination of Processing Charge of Retrieval, Evaluation, Preservation & Transportation of Corneal Tissue in HOTA - 2024 Rule 09 for distribution of surplus corneas collected by State Eye Bank, RIO, RIMS under Jharkhand Cornea Distribution System. Decision - After consideration, the rate recommended by the committee constituted at RIMS level was approved for fixation of charge of Retrieval, Evaluation, Preservation & Transportation of Corneal Tissue for the above proposed cornea distribution.

Discussion and decision on the process of providing material for funeral work under Rs. 5000/-.

Decision - After consideration, it was decided to ensure to ensure payment of 5,000 via UPI to the family of the deceased on the spot for the funeral rites. It was decided to implement this arrangement with immediate effect.

Determination for Faculty posts approved for Hospital Decision on educational qualification previously Management Department by IMS Governing Council and appointment of faculty from internal fund till the post is approved. Decision - The proposal for creation of the above posts for the Hospital Management Department was approved in the agenda no 6.4 of the 6th meeting of the Standing Finance and Accounts Committee dated 10.12.2020 and in the 50th meeting of the Governing Council dated

28.01.2021. In the 59th meeting of the RIMS Governing Council, it was decided to get the eligibility determined from the RIMS Academic Committee. Hence, in the light of the decision taken in the 59th Governing Council, the eligibility of the faculty of the Hospital Management Department was determined in the 6th meeting of the RIMS Academic Committee dated 25.09.2025, which was approved. Till the posts are created, Faculty appointment from the internal resources was approved. Proposal to placed in next meeting of SFC.

Due to ongoing departmental investigations, the payment process for two Modular OT and Integration OT installed in the Department of Pediatric Surgery, totaling 7,24,85,274, is pending. Discussion and decision on payment of pending bills in the light of the decision of the 55th meeting of the Governing Body. Decision - After consideration, it was decided to pay the total amount of all the bills on the basis of the Health Department investigation report.

Decision to increase seats in various Super Specialty Courses run in the institute and to start new Super Specialty Courses.

Decision - it was informed that the proposal to increase the existing 180 MBBS seats in RIMS to 250 was rejected by the National Medical Commission. It was decided after deliberation that an appeal should be made to the National Medical Commission (NMC) again and a copy of the same should be made available to the Health Department. Also, instructions were given to make efforts to increase the seats of Postgraduate MD/MS conducted in RIMS to 250. Approval was

given to start the above proposed Superspeciality Course (DM/ DNB)

Decision regarding the interview of eligible applicants received for the advertised positions at RIMS, Ranchi.

Decision - It was decided to nominate a retired/working Additional Chief Secretary/Chief Secretary as the Chairman of the Selection Committee for appointment to the posts of doctors. It was also decided to send a proposal to the State Government to amend the Selection Committee contained in Schedule V of the RIMS Regulations.

Miscellaneous agenda items with the permission of the Hon'ble Chairman, Governing Body. Discussion and decision on the order passed by the Hon'ble High Court of Jharkhand in W.P. (Jyoti Sharma vs. State of Jharkhand and others) dated 19.09.2025.

Decision - In the above case, the Governing Body was informed of point 14 of the judgment dated 19.09.2025. it was also informed that all almost all general pathological and radiological tests (MRIs) are being performed at RIMS, Ranchi, except for MRIs and Pet Scan. All department heads have been directed not to send patients outside for testing. Patients will be provided with MRI testing facilities after the MRI machine is installed and operational within one month.

After discussion, it was directed that the Uncommon tests that are not being performed at RIMS should be identified and reports regarding the necessary equipment, chemicals, and workforce should be obtained from all departments to establish testing facilities. The report should be made to the Standing Finance and Accounts

Committee, and full sledged testing facilities should be established within the next eight months.

1. Instructions were given to complete the tendering and purchase of specific medical equipment (such Ventilators, Monitors, and others) approved in the last meeting of the Standing Finance and Accounts Committee and the Governing Body within two to three months.

2. It was decided to hold the next meeting of the Governing Body of RIMS on 12.11.2025.

5. Likewise, the State has also filed its affidavit and we shall have to reproduce para 8 thereof which reads as under:-

"8. That it is relevant to state here that the Governing Body, RIMS in its 61st Meeting held on 13.09.2025 under the chairmanship of the Hon'ble Departmental Minister wherein appropriate decision has been taken on 16 proposal laid down in the meeting which are as follows:

A. Discussion and decision on the appointment of vacant posts in the medical cadre under RIMS i. Approval was given to conduct interviews for the vacant posts of Assistant Professor in the advertised medical cadre posts and to complete the appointment process.

ii. A four-member committee was constituted to review the recruitment process for the remaining advertised higher posts of the medical education cadre, such as Professor, Additional Professor, and Associate Professor.

iii. Approval was given to complete the appointment process as per rules for all the remaining advertised Group 'A' posts B. Discussion and decision on appointment to vacant posts of Senior Resident/Tutor under RIMS, Ranchi:

Approval was given to extend the tenure of senior resident doctors only once for one year at the level of Director RIMS C. Discussion and decision on appointment to vacant posts of Class III and Nurse cadre under RIMS, Ranchi:

i. Before regular appointment to the vacant posts of Class III (Nursing and Paramedics), a proposal for amendment in the existing rules was directed to be prepared and presented in the next Governing Council meeting.

ii. It was informed that no regulations have been established for clerical positions at RIMS. In this regard, it was decided that a proposal for such regulations should be prepared at the RIMS level in accordance with the State Government and keeping in view the autonomy of RIMS, and the proposal should be presented at the next Governing Council meeting. iii. Approval was given to adopt the rules of appointment, promotion, and service conditions of the clerical cadre applicable in the State Government until separate rules for

the clerical cadre are framed in RIMS.

      iv.     Instructions    were       given     to
      maintain            manpower            through

outsourcing arrangements against approved vacant posts until regular recruitment is completed D. Discussion and discussion on the appointment of vacant posts of Class IV cadre under RIMS, Ranchi:

All the members were informed about the actual position of the posts of the Class IV cadre under RIMS, Ranchi, and the appointments made under the direction of the Hon'ble High Court. It was further informed that no rules have been framed for the Class IV cadre posts in RIMS. After consideration, instructions were given to prepare such rules, keeping in mind the directions of the Hon'ble Jharkhand High Court, the interests of the employees already working in RIMS, and local requirements E. Discussion and decision on creation of posts required for establishment of new departments in the previous Governing Council meetings under RIMS, Ranchi:

A proposal should be placed before the Governing Council after approval by the Standing Finance and Accounts Committee and the Ad Hoc Committee, in compliance with the provisions contained in the RIMS Regulations, 2014. It was also decided to review the proposal for

creation of posts approved by the previous Governing Council and to send a report to the Health Department soon F. Decision on purchase of various materials (machine equipment and consumables, medicine, reagents) as per requirement in various departments under RIMS, Ranchi to provide necessary medical facilities to the patients:

i. Approval was given to purchase 24 types of equipment Proposed in the G.B meeting, for which rates had been approved by the Standing Purchase Committee and for which the budget was sanctioned in the financial year 2022-23 or 2023-24, but due to delays in conducting/executing the tender process, the amount for the said financial years had been surrendered. The purchase shall now be made from the amount available in the State Plan Budget.

ii Proposals for materials whose purchase has not yet been approved by the Standing Finance and Accounts Committee were directed to be placed before the next committee meeting.

iii. Approval was given to purchase one MRI machine in addition to the MRI machine currently being installed at the Regional Eye Institute.

G. Discussion and decision on the status of construction of a new building and

renovation of old buildings at RIMS, Ranchi i. The members of the Governing Council were informed about the details of administrative approvals received from the State Government for renovation and construction of new buildings mentioned in the proposal.

ii. As per the provisions/rules contained in the RIMS Rules, 2002 and Regulations, 2014, proposals related to all construction works were directed to be presented in the next meeting of: the Governing Council after obtaining approval/sanction from the Standing Estate Committee.

iii. To ensure quality and timely completion of new construction or renovation work, it was decided to authorize other State Government agencies such as Jharkhand Police Housing Corporation and Urban Development and Housing Department, in addition to the Building Construction Department and Building Construction Corporation Limited, to undertake such works, and to present scheme- wise proposals before the Governing Council.

H. Decision on carrying out emergency repair/renovation work of dilapidated buildings in RIMS, Ranchi:

Approval was given for the execution of all six types of day-to-day

maintenance works mentioned in Schedule : 03 attached to the proposal, from the amount available under the non-plan head, with the condition that after completion, the related works will continue for the . next five years, and the Building Construction Department will be responsible for maintenance. It was also directed that information regarding items 1 and 2 be provided to the Building Construction Corporation Limited to avoid duplication during the main renovation project (RIMS redevelopment plan) I. Decision on the proposal for solution of problem of drinking water supply and water logging in RIMS campus:

         The        decision            approved           the
         nomination          of         the      Executive
         Engineers of the Drinking Water

and. Sanitation Department and the Energy Department as members of the Permanent Estate Committee of RIMS and ensured their attendance who shall be invited as special invitees until the rules are amended. Approval was given to prepare an SOP at the level of the Drinking Water and Sanitation Department for all buildings/ units located in the RIMS campus, to ensure daily inspection and quality repair work as required, and to submit monthly

reports of related works to the Director, RIMS.

The RIMS management was also directed to provide an adequate number of water purifiers, and the Drinking Water and Sanitation Department was directed to ensure an uninterrupted clean water supply.

J.   Decision      on        a     proposal        for
comprehensive           patient-               friendly

improvements to the Trauma Center and Central Emergency:

i. A directive was issued to immediately convert the 78 beds at the Trauma Centre into ventilator-• equipped beds. Approval was given to purchase100 ventilators as soon as possible for the beds lacking them.:

ii. 171 posts have already been created for the Trauma Centre and Central Emergency. Instructions were given to fill the approved vacant posts as soon as possible and to maintain manpower through external sources until such appointments are made.

iii. It was decided to place proposals for the creation of necessary posts, purchase of machinery and equipment, and expansion of infrastructure for comprehensive improvement of the Trauma Centre and Central Emergency before the next Standing Finance and Accounts Committee

K. Decision on the proposal to stop private practice of doctors working in RIMS:

To improve efficiency, it was decided to strengthen the biometric attendance system for all officers and employees of medical and other cadres, install CCTV cameras for monitoring, and assign the Director, RIMS, the responsibility for overseeing attendance. The Director was also directed to provide an authentic list of doctors engaged in private practice to the Governing Council.

L. Decision to implement Biometric Attendance to ensure the presence of doctors and staff working in RIMS in the hospital:

The decision reiterated the existing provisions in Section 33 of the RIMS Regulations and directed the RIMS authority to ensure compliance. The authority was further directed to periodically upgrade biometric devices and ensure attendance.

M. Decision on the proposal to form a committee/advisory board of specialist doctors from renowned medical institutions of the country to give advice for improving the system of RIMS:

The proposal to form such an advisory board was approved, and it was decided to include the former Director, Dr. Kameshwar Prasad, as a member. A detailed proposal regarding its formation was directed

to be presented in the next Governing Council meeting. N. Decision on the proposals made by the Hon'ble High Court in W.P. (PIL) 4736/2018 (Jyoti Sharma vs SOJ & Others) on the inspection report of the Advocates:

The Governing Council members were informed of the inspection report submitted by the advocates committee nominated by this Hon'ble Court and directed to take necessary action at the RIMS level on the suggestions made. They also directed strengthening of the burn ward system and ensuring the RIMS campus is made encroachment-free in coordination with the district administration.

O. Decision on the directions given by the Hon'ble High Court, Jharkhand in WP (PIL) No. 4736 /2018:

A proposal report for amending Clause 4 of Section XII of the RIMS Regulations, 2014, was directed to be prepared at the RIMS level and presented before the next Governing Council meeting.

P. To apprise the honorable members about the compliance report of the audit report of various financial years of RIMS:

The Governing Council members were apprised of the compliance actions taken by RIMS on the audit reports of the Accountant General Photocopy of the minutes of meeting dated 13.09.2025 is annexed

herewith and marked as Annexure A."

6. In order to adjudge the correctness and the veracity of the affidavits that have been filed by the RIMS and the State Government respectively, we appoint the Member Secretary, JHALSA, who shall submit a report within one week from today.

7. In addition thereto, the Member Secretary, JHALSA shall also furnish a report with regard to (i) cleanliness, (ii) availability of blankets, (iii) medicines, (iv) pathological facilities, (v) adequacy/inadequacy of medical equipments, (vi) overall hygiene of the hospital, (vii) availability of drinking water,

(viii) blankets, pillows and bed-sheets for the patients, (ix) quality of the food served for the patients as well as the attendants in the canteens and cafeterias in the hospital and maintenance of attendance through biometrics. The Member Secretary, JHALSA shall especially visit the trauma and the cardiac centers of the hospital. Specific report regarding encroachment of the RIMS premises shall also be furnished within a period of 10 days from today. The State authorities are directed to extend all necessary facilities and cooperation to the Member Secretary, JHALSA and the RIMS also so as to enable her to submit a report.

8. It was with hope that the functioning of the RIMS gets better that we had passed the aforesaid orders and had, in fact, directed the RIMS to convene the Governing body meetings to resolve all the issues. However, it is unfortunate that only

two meetings were held, especially when the Court is already in seisin of the matter and the meeting schedule for 12th November, 2025 has been postponed indefinitely. Therefore, let the Governing body meeting be promptly convened and held on 27th November, 2025 at 11:00 A.M. for which again we request Hon'ble Mr. Justice Amareshwar Sahay, a retired judge of this Court to act as an observer. The State shall make all necessary arrangements for the observer, who has to facilitate his presence in the next meeting.

9. All pending issues be resolved in the said meeting, failing which this Court may have to draw contempt proceedings against the members of the Governing body.

10. List on 03.12.2025."

2. It is not in dispute that the RIMS was established in the year

1959 by an Act of its Legislative Assembly.

3. Pursuant to this Act, the land was acquired for establishment of

RIMS.

4. In compliance to the order passed by this Court on 20.11.2025,

the Member Secretary, JHALSA, has submitted a report which reads

as under:-

"Report prepared in the light of order dated 20.11.2025 of Hon'ble

High Court of Jharkhand in WP (PIL) No. 4736 of 2018.

Hon'ble High Court of Jharkhand has been pleased to direct

inter alia that:

"Para7... Specific Report regarding encroachment of the

RIMS Premises shall also be furnished within a period of 10 days

from today..."

In compliance of Order of Hon'ble High Court of Jharkhand,

undersigned has visited and inspected entire RIMS premises on

26.11.25 and 27.11.25, in presence of Estate Officers and Medical

Superintendent of RIMS, Circle Officer, Ameen and other staffs of

Badgai Anchal.

Circle Officer Badgai has submitted a map of RIMS

(acquired area), in which he has shown the entire area of acquired

land by RIMS and land encroached (in red ink) through the map. He

has also shown the details of land in the map. The land was situated

in four Mauza namely:

Mauza Morabadi - Thana no. 192-P.S. Ranchi

Mauza Kokar - Thana no. 196-P.S. Ranchi

Mauza Bariyatu - Thana no. 194-P.S. Ranchi

Mauza Tiril - Thana no, 195-P.S. Ranchi

It has further been shown that area of 8 acres of land are

encroached in Morabadi mauza and 1.65 acres of land in Kokar

mauza. However, no encroachment is shown in Bariyatu and Tiril

mauza in the aforesaid map. Further RIMS administration has also

shown and submitted one map in which encroachment has been

shown by marking it in red ink.

Undersigned has further interacted and enquired the matter

with representatives of RIMS administration as well as District

Administration regarding encroachment and thereafter physically

verified several spots, where land of RIMS was encroached.

1. Encroachment in front of old emergency gate of RIMS

Undersigned has found that one temple was

constructed at the premises of RIMS and even 1" floor above

the aforesaid temple was being constructed. Besides that

almost 10-20 shops were in existence and are running near

the temple within the premises of RIMS. Further, at the side

of OPD almost hundreds of street vendors have also

temporarily established their carts (thelas), thereby

restricting the mobility of the emergency vehicle such as

ambulance to even pass from that road. It has been submitted

by the Representative of RIMS that no place of parking is

designated within the campus. However undersigned has

found some signage denoting no parking area but many

vehicles were parked in those areas restricting the

passage/road within the campus. Even in case of emergency,

it affects the mobility of ambulance, which can create instant

life threat to the patients.

2. Encroachment at DIG ground (commonly named by the

villagers)

Undersigned has further visited and inspected the 2nd

place which was generally named by the villagers as DIG

ground and found that a park was constructed at the RIMS

premises, which was named as Buddha Park. 3-4

multistoried buildings were also constructed within the

acquired area of RIMS. Beside this park, one field about

150x350 ft was also found encroached. The surrounding of

the said field was fenced, where agricultural work was being

done. During enquiry it has been disclosed that the piece of

land was illegally occupied by DIG Saheb

One PCC road has also been constructed within the

campus. It has also been found that one statue of Birsa

Munda has been set up along with one stage in the middle of

the ground. One Apartment has also been constructed near

the DIG ground and the flats therein have been sold without

wailid paper

More than 150 kuchha houses/pucca houses were

also constructed near the aforesaid ground. All these

constructions are over the RIMS acquired land

On enquiry, the representative of RIMS

administration, has submitted that several warnings were

also given to these persons, but they constructed these

permanent structures as well as kachcha makan beside DOG

ground. He has also submitted that RIMS has not filed any

FIR in this regard. He further submitted that local people

have broken the boundary will and use the RIMS land as

passage. It also came to knowledge that many of the pilots

which are the part of acquired land of RIMS were sold and

mutated in the name of private person. Though CO Office

could not specify the name of those people.

Representatives of District Administration have

submitted that notices have also been issued to the persons

who have encroached the land but they are not vacating it.

3. Encroachment at North Campus at RIMS (Adjacent places near

four lame road called Bariatu Road)

Undersigned has further visited the place which was adjacent

to the Bariatu road and found that 2 temples were in existence and

one more temple is under construction within the acquired land of

RIMS. One temporary construction was also made at the backside of

the temple. Total area encroached there is about 5000 sq.m.

On enquiry, it has been submitted by the RIMS

administration that they have tried to stop the construction of 3rd

temple at the RIMS campus, but administration is not cooperating.

Further, about 25 temporary constructions over RIMS

acquired land in North Campus was also found and old buildings

(Quarter) of doctors are also illegally occupied by some locals and

staff of cleaning agency. RIMS administration stated in this regard

that local police station is not cooperating to vacate these quarters.

It also came into knowledge that at many places the local

people had broken the boundary of RIMS and uses it as unauthorized

passage.

4. Encroachment near Girls' hostel situated at North Campus

Undersigned has further visited and inspected the

encroached area which was situated near girls hostel of RIMS and

found that boundary wall was broken. One PCC road was

constructed by the government within the acquired area of RIMS.

20-30 temporary illegal constructions were found there. Some small

shops were also constructed there illegally.

On enquiry, RIMS administration submitted that due to

broken boundary wall, encroachments are increasing and there is

issue of safety and security of girl students of hostel. Incident of theft

are also happening. They have also submitted that 15ft. outer circle

road of the RIMS campus was made available for the common

people but new PCC roads are being regularly constructed within

the middle of the campus.

CONCLUDING REMARKS

The inspection established that RIMS continues to suffer from

multiple unauthorized encroachments affecting its functioning and

despite repeated notices and warning, no comprehensive steps have

been taken by the District Administration, even RIMS administration

has not filed single FIR in the matter.

 Encroachments in the form of temples, shops, common

building, schools, sarna sthal, park, residential structures,

and other constructions obstruct essential hospital services.

 These structures contribute to congestion, hygiene failures,

and serious safety hazards within the campus.

 The RIMS administration as well as District Administration

have not implemented a time-bound or coordinated plan for

eviction and removal of encroachment.

 The continuing encroachment reflects systemic

administrative lapses and lack of accountability.

 Immediate joint action is necessary to comply with the

Hon'ble High Court's orders.

Undersigned is annexing herewith map produced by

CO Office (land of RIMS highlighted in sea blue ink) and RIMS

Administration separately. Both the maps highlight the encroached

area in red ink. Besides the area marked in red ink, undersigned has

also highlighted additional encroached area, in neon colour ink,

found during physical inspection.

5. As observed above, the RIMS has been established pursuant to

an Act and structures thereupon belonging to the RIMS are over the

land that was lawfully acquired. Any other structure, which is not

belonging to the RIMS, essentially, therefore, has to be considered to

be an encroachment. There cannot be a lawful ownership or any other

claim of person or authority over the land belonging to the RIMS,

especially within the precincts of RIMS.

6. We, therefore, deem it appropriate to grant 72 hours to the

encroachers who are squatting over the land or building(s) of the

RIMS, to remove their belongings and hand over peaceful possession

of the land to the RIMS, failing which, the District Administration shall

take all necessary steps of evicting the encroachers and report

compliance within one week.

7. The Senior Superintendent of Police, Ranchi shall ensure

adequate deployment of police force so as to thwart any untoward

incidence.

8. Any person(s) or authority creating any hindrance or obstructing

the Administration from carrying out the eviction, in addition to other

lawful steps that shall be taken against such person(s)/authority, shall

be guilty of having committed deliberate and willful contempt of the

order of the Court.

9. Let a copy of the report of Member Secretary, JHALSA, be

supplied to the State as well as the RIMS.

10. The other reports submitted by the Member Secretary shall be

considered on the next date of hearing.

11. The State will make adequate publicity of the order passed by

this Court so as to facilitate the encroachers to remove their

belongings within the stipulated time.

12. No Court other than this Court shall entertain any claim arising

out of or connected with this order.
