1. This is an application filed by the petitioners who happens to

be the father-in-law and husband, praying for grant of

anticipatory bail in terms of Sections 482 and 484 of Bhartiya

Nagrik Suraksha Sanhita, 2024, as the petitionershave been

allegedly implicated in connection with Complaint Case No.

744 of 2021 for the offences punishable under Section 498A of

the Indian Penal Code and Section 3/4 of D.P. Act, pending in

the court of learned J.M. 1st Class, Rajhamhal.

2. The counsel appearing on behalf of the informant submits that

after cognizance was taken, summons was issued, the

petitioner did not appear. Thus, bailable warrant was also

issued but the petitioner did not appear. Thus, thereafter,

having no other alternative, the Court had issued non-bailable

warrant of arrest.Thus, the petitioner has approached this

Court.

3. Since, this is the complaint case and the petitioner has not

appeared in spite of issuance of the summons and bailable

warrant, the Court currently issued non-bailable warrant of

arrest to the petitioner for his appearance. The petitioner

should appear before the court concerned, who will consider

their case as per judgment rendered by Hon'ble Supreme

Court in the case of Satender Kumar Antil vs. Central

Bureau of Investigation & Another, reported in 2022 (10)

SCC 51.

4. This anticipatory bail application is disposed of.
