Order No.17 /Dated: 25th April 2025 The grievance of the petitioner is that he has been granted 1st and 2nd ACP vide order dated 19.12.2011 after his retirement, however, monetary benefit has not been given to him till date. Learned counsel for the petitioner relies upon several judgments passed by the Hon'ble Apex Court and also by the Patna High Court.
Learned counsel for the respondents submits that in the notification itself there is a provision for passing of departmental examination as such the petitioner is not entitled for monetary benefit but learned counsel for the respondents is not able to demonstrate why the order was passed in favour of petitioner for 1st and 2nd ACP vide order dated 19.12.2011 and monetary benefit has not been paid.
