1. Heard the learned counsel appearing on behalf of the parties.
2. Learned counsel for the parties have commenced their arguments.
3. It transpired during the course of hearing that it has come in the evidence of the plaintiff that the suit property was sold in favour of one Sunita Seth W/o Sunil Kumar Seth by means of a registered sale-deed bearing No. 3124 dated 22.05.2009 and that her name was also mutated in the records of M/s Tata Steel Limited wherein a multi-stored building has been constructed. The said sale-deed was admittedly executed during the pendency of the suit. However, the plaintiff did not take any step to make the purchaser, namely, Sunita Seth a party to the proceedings.
4. Learned counsel for the appellant has submitted that she would examine as to whether the purchaser of the suit property during the pendency of the suit for specific performance of contract was at all required to be made a party in the proceedings and place the judgments with respect to this aspect of the matter. She prays that the matter may be adjourned.
5. At her request, post this case for further hearing tomorrow i.e. 16.04.2025 at 10:30 a.m. as the first case.
