It is the case of the petitioner that similarly situated accused arising out of same FIR has been granted the privilege of premature release but this petitioner has been deprived of the same. It is his case that he is in custody for 23 years without remission. He further submits that others have been given the benefit of premature release but the case of the petitioner has been rejected without differentiating the case of the petitioner with the others.
At this stage learned counsel appearing on behalf of the State prays for six weeks' time to file an additional affidavit stating how the case of the petitioner stands different from those who have been prematurely released arising out of the same judgment by which the petitioner has been convicted.
List this case after six weeks.
