Order No: 05/ Dated: 09.04.2025 Ms. Sunita Kumari has appeared through Video Conferencing on behalf of the Appellant. There is no complaint of audio and video quality. Mr. Arup Kumar Dey, learned counsel for the State is also present.

2. Learned counsel for the appellant prays for time on her personal grounds and submitted that the case may be fixed on the next date fixed in this case.

3. It appears that notice has not been served upon the guardian of the Victim girl 'X'.

4. Under the circumstances, learned counsel for the State is directed to get served the notice of this Criminal Appeal upon the guardian of Victim girl 'X' through Superintendent of Police, Gumla in the light of the judgment rendered in the case of Nipun Saxena and Anr. Versus Union of India reported in (2019) 2 SCC 703 and also vide Notification No. 23/2023/R&S/JHC dated 20.12.2023 issued by the High Court of Jharkhand and shall file an affidavit regarding service of notice upon the guardian of victim girl 'X'.

5. Learned counsel for the State is directed to produce the neatly typed copy of the case diary.

6. Call for the statement of victim girl recorded under Section 164 Cr.P.C and medical report of the victim girl from the learned Court below.

7. Put up this case after receipt of the same.

8. Let a copy of this order be sent to the Office of Superintendent of Police, Gumla by FAX and be also handed over the learned counsel for the State for the needful and be also sent to the learned Court below.
