11 /23.09.2024: I.A. No.10201 of 2024 This interlocutory application has been filed by the appellant No.- Sanjeet Singh @ Sanjeet Ku. Singh @ Sanjit Singh, praying therein to suspend the sentence and release him on bail during the pendency of this appeal.

2. The appellant has been convicted for the offence under Section 302 of IPC, in connection with Sessions Trial No.207 of 2017. He has been sentenced to undergo rigorous imprisonment for life with a fine of Rs.1,00,000/-, for the offence under Section 302 of IPC.

3. Heard, learned counsel for the appellant and learned A.P.P. for the State and have gone through the impugned judgment, the evidence and the Trial Court Records.

4. Opportunity was given to the State to oppose the bail, which the State availed and opposed.

5. The appellant No.1 renews his prayer for bail, whose prayer for bail was earlier rejected on 14.10.2020. The ground taken by the learned counsel for the appellant is that he is in custody since 7 ½ years.

6. It is not necessary to go through the entire evidence, suffice it would be to note that P.W.-1, who is an eye witness has stated that this appellant shoot dead the deceased- Niranjan Prasad Yadav.

7. Considering the direct nature of evidence, more so, when the sentence is for life, we are not inclined to release the appellant on bail.

8. Accordingly, I.A. No.10201 of 2024 stands dismissed.

9. It will be open for the appellant to prefer a petition for early hearing of the appeal.
