1. Heard the parties.

2. This criminal miscellaneous petition has been filed invoking the

jurisdiction of this Court under Section 528 of the B.N.S.S., 2023

with a prayer for quashing the order dated 28.06.2024, passed in

connection with Ahilyapur P.S. Case No. 47 of 2023 by learned

Additional Sessions Judge-II-cum-Special Judge (Cyber Crime),

Giridih whereby and where under the learned Additional

Sessions Judge-II-cum-Special Judge (Cyber Crime), Giridih has

directed to issue the proclamation under Section 82 Cr.P.C. inter-

alia against the petitioner and the said case is now pending in the

court of learned Additional Sessions Judge-II-cum-Special Judge

(Cyber Crime), Giridih.

3. The learned counsel for the petitioner submits that the self-same

prayer made by the petitioner in this criminal miscellaneous

petition has already been allowed by this Court vide judgment

dated 19.08.2024 in Cr.M.P. No. 2362 of 2024. Hence, it is

submitted that the prayer of the petitioner has become

infructuous.

4. Accordingly, this criminal miscellaneous petition is dismissed

being infructuous.
