I.A. No.5269 of 2024 in Criminal Appeal (D.B.) No.1114 of 2023

This Interlocutory Application has been filed by the

appellant - Karan Dhobi, praying therein to suspend the

sentence and release him on bail during pendency of this

appeal.

2. The appellant has been convicted and sentenced in

connection with Special (POCSO) Case No.150 of 2021. He has

been convicted for the offence under Section 376 DA of I.P.C.

and Section 6 read with Section 5 (g) of POCSO Act. He was

sentenced to undergo imprisonment for life with fine of

Rs.10,000/- under Section 376 DA of I.P.C.

3. Heard, learned counsel for the appellant and learned

A.P.P. for the State and have gone through the impugned

judgment, the evidence and the Trial Court Records.

4. Opportunity was given to the State to oppose the

bail, which the State availed and opposed.

5. There is an allegation that the victim was raped by

two boys. Thereafter, to shut the mouth of the parents and

restrict them from filing police case, Rs.50,000/- was given to

the parents.

6. The P.W.-3 is the father of the victim, who stated

that they have forcefully given money which was being handed

over by them to the police official.

7. The police official in para-3 of his statement has

supported the aforesaid fact.

8. Considering the aforesaid evidences, we are not

inclined to release this appellant on bail.

9. This interlocutory application is, accordingly,

dismissed.
