This first appeal has been preferred against the judgment and decree passed by the Civil Judge (Senior Division)-IX, Dhanbad in Original Suit No. 436 of 2019. As per Section 21 of The Bengal, Agra and Assam Civil Courts Act, 1887, an appeal from a decree or order of a Subordinate Judge which has been renamed as Civil Judge (Senior Division) shall lie to the District Judge (which has been renamed as Principal District Judge) where the value of the Original Suit in which or in any proceeding arising out of which the decree or order was made was less than Rs.25,00,000/- and to the High Court in any other case.

Since the valuation of the appeal is Rs.13,50,500/- and the suit was also valued at 13,50,500/- as mentioned in page no.3 of this appeal is not maintainable in this court. Accordingly, this appeal is dismissed being not maintainable in this Court.
