On call, the learned counsels for the parties have appeared. The present interlocutory application has been filed on behalf of the petitioner for exemption to surrender in view of joint compromise dated 06.04.2024 in connection with judgment dated 29.1.2024 passed by the District and Additional Sessions Judge-III, Lohardaga in Cr. Appeal No. 53 of 2023 whereby he pleased to uphold the trial court judgment dated 19.6.2023 passed in Complaint Case No. 150 of 2021.

The learned counsel for the petitioner and the learned counsel for the opposite party no.2 have submitted that both the parties have compromised the case outside the court on 6.4.2024 and compensation amount of Rs. 8,50,000/- has been transferred, that is, 5,00,000/- through mobile transaction, Rs. 1,50,000/- in cash and Rs. 2,00,000/- by cheque no. 011940 BOI Branch, Patratoli, Lohardaga which were received by the opposite party no.2 which is annexed as Annexure-A series to the interlocutory application.

The learned counsels thus submitted that in view of the aforesaid settlement, prayer made by the petitioner in the present interlocutory application may be allowed and the present criminal revision may be disposed of.

Having heard the learned counsels for the parties and in view of the compromise as well as Annexure-A series to the present interlocutory

application, the petitioner is exempted from surrendering in connection with Cr. Appeal No. 53 of 2023 / Complaint Case No. 150 of 2021.

Accordingly, IA No. 3794 of 2024 is allowed and disposed of. In view of aforesaid compromise which has taken place between the parties, the judgment dated 29.1.2024 passed by the District and Additional Sessions Judge-III, Lohardaga in Cr. Appeal No. 53 of 2023 and the judgment dated 19.6.2023 passed by the learned Judicial Magistrate, 1 st Class, Lohardaga in Complaint Case No. 150 of 2021 are set-aside.

Cr. Revision No. 344 of 2024 is allowed.
