As per the office note defect was pointed out with

regard to payment of Court fee.

2. Learned counsel for the petitioner submits that the

impugned order which has been assailed in this writ

application was issued affecting several persons having

common interest and as such separate Court fee will not be

required. He further submits that for exemption of court fee

he has filed I.A. No. 8757 of 2024; wherein he has annexed

several judgments passed by Division Bench of Patna High

Court as well as by Co-ordinate Bench of this Court.

3. Having regard to the aforesaid submission and looking

to the averments made in this I.A and also after going

through paragraph 5 of the judgment passed by the Patna

High Court reported in 1998 SCC Online Pat. 420 and several

orders delivered on this issue.

4. The objection raised by the registry is inconsistent and

the defects with regard to payment of court fee is, hereby,

ignored.

5. I.A. No. 8757 of 2024 stands allowed.

W.P.(S) No. 7071 of 2024.

6. Learned counsel for the respondent prays and is

allowed four weeks' time to file counter-affidavit.

7. List this case on 17.10.2024.
