Order No:-09 Dated:-14-10-2024 Heard the learned counsel for the appellants. This appeal will be heard on the following substantial questions of law:-
(i) Whether the learned first appellate court has committed perversity by though in the judgment passed in Civil Appeal No.19 of 2010 arising out of Title Suit No.05 of 2006 of the court of learned Sub-Judge- III, Rajmahal in operative portion, setting aside all the findings of the trial courts but in the judgment of Civil Appeal No.19 of 2010 arising out of the same impugned judgment dated 26.03.2010 in Title Suit No.05 of 2006, in answer to the point for determination No.5 in internal page-29 of the judgment, confirming the findings of the trial court in respect of this appeal?

Call for the lower court records. Issue notice to the respondents. The appellants are directed to file requisites for service of notice upon the respondents by registered post with A/D as well as under process of the court within four weeks failing which; this appeal shall stand dismissed without further reference to the Bench.
Rule is made returnable within six weeks. List this appeal after receipt of the service report of the notice upon the respondents.
