02/12.11.2024      Heard learned counsel for the parties.

2. The petitioner apprehending his arrest in connection with the case

registered under Sections 41/42 of the Indian Forest Act has prayed for grant of

anticipatory bail.

3. Learned counsel for the petitioner submits that the petitioner has been

falsely implicated in this case and has not committed any offence as alleged in

the offence report. It has been alleged that 90 pieces of Sal logs were found

illegally stored for sale at the instance of the petitioner. It is further submitted

that the petitioner's name has surfaced in this case merely on the basis of the

hearsay statements of few villagers. Except the said fact, there is no other

material to connect the petitioner with the alleged offence. Though one more

criminal case of similar nature was lodged against the petitioner being Arki P.S.

Case No. 26/2016, however, he has been acquitted in the said case vide

judgment dated 06.02.2020 passed by the C.J.M, Khunti in G.R. No. 351/2016.

The said statement has been made in paragraph 17 of the present anticipatory

bail application. He however undertakes to cooperate in the trial. Hence, he may

be given the privilege of anticipatory bail.

4. Learned A.P.P opposes the petitioner's prayer for anticipatory bail.

5. Considering the aforesaid facts and circumstances of the case, I am

inclined to enlarge the petitioner on anticipatory bail. Accordingly, the above

named petitioner is directed to surrender before the concerned Court below
