This appeal is admitted and will be heard on the following substantial questions of law:
i. Whether learned both the courts below have failed to properly appreciate the customary law of inheritance among the Santhal? ii. Whether the judgments rendered by learned both the courts below are perverse for not considering Exts. 6, 7 and 8 adduced on behalf of the plaintiff?
The other substantial question of law, if any, shall be formulated at the time of hearing of the appeal.
Let the lower court records be called for from the court below concerned. Learned counsel for the appellants is directed to serve notice upon the respondents for which requisites etc. under registered cover with A/D as well as under ordinary process must be filed within two weeks.
Let this case be listed after six weeks under the appropriate heading.
