I.A. No.3718 of 2023 and I.A. No.2835 of 2022

15/03.05.2024 By way of filing these interlocutory applications, the

appellant has renewed his prayer to suspend the sentence and release

him on bail, during pendency of this appeal.

2. The appellant has been convicted and sentenced in

connection with S.T. No.420 of 2017, T.R. No.71 of 2017 for the offence

under section(s) 307 of the Indian Penal Code. He has been sentenced to

rigorous imprisonment for life and fine of Rs.10,000/- and in default of

payment of fine, the appellant has been further sentenced to undergo

simple imprisonment for three months.

3. Heard the learned counsel for the appellant, leraned A.P.P.

for the State and the learned counsel for the informant and have gone

through the impugned judgment, the evidence and the Trial Court

Records.

4. Opportunity was given to the State to oppose the bail,

which the State availed and opposed.

5. It appears that the appellant was earlier convicted for the

offence under section 307 of the IPC for ten years.

6. The learned APP and the learned counsel for the informant

submit that on both the occasions the appellant was made attempt on

victim of this case.

7. Thus, we don't find any ground to suspend the sentence

during pendency of this appeal. Accordingly, the prayer for suspension of

sentence is hereby rejected.

8. This Interlocutory Applications, being I.A. No.3718 of 2023

and I.A. No.2835 of 2022 stand dismissed.

9. However, the appellant is at liberty to file an application

praying therein for early hearing of this case.
