05/11.06.2024 The learned Senior counsel for the petitioner has submitted that the activity of the petitioner is not covered under the provisions of the Factories Act, 1948 and, therefore, the impugned direction issued by the respondents calls for interference. The learned counsel has also submitted that the sub-station is not a factory as defined under section 2 (m) of the Factories Act which defines the term "factory".
2. During the course of argument, the definition of "manufacturing process" as defined under section 2 (k) of the Factories Act, 1948 has been placed and it is observed by this Court that by virtue of section 2 (k) (iii) generating, transforming or transmitting power has been specifically included within the definition of "manufacturing process".
3. At this, the learned counsel for the petitioner submits that he shall further advance his arguments tomorrow and place judgments which he seeks to rely upon.
4. Post this case tomorrow i.e. on 12.06.2024 for further hearing at 2.15 p.m.
