1. The applicant has approached this Court for grant of privilege of anticipatory bail, in connection with Jogta P.S. Case No.29 of 2023, registered for the offence under Sections 414/ 420/ 467/ 34 of the Indian Penal Code and Sections 4/ 21 of the Mines and Mineral (Development and Regulation) Act, pending in the court of learned Judicial Magistrate, Dhanbad.

2. After some argument, learned counsel for the applicant seeks permission to withdraw the present anticipatory bail application with a liberty to approach the court below for grant of regular bail and to place all the judgments of the Hon'ble Apex Court relevant in the case.

3. Learned counsel for the State has no objection.

4. In view of the submission of the learned counsel for the applicant, the present anticipatory bail application stands dismissed as withdrawn with the aforesaid liberty.

5. However, if the applicant surrenders and prays for grant of regular bail, the court below is directed to consider the prayer for bail of the applicant on its own merit and also keeping in mind the mandate of the Hon'ble Apex Court, without being prejudiced by the order of withdrawal.
