Learned A.P.P., in view of the judgment rendered by the Hon'ble Apex Court in the case of Jagjeet Singh & Ors. Vrs. Ashish Mishra @ Monu & Anr.[(2022) 9 SCC 321] and also in the case of 'X' Vrs. State of Maharashtra & Anr.[2023 SCC OnLine SC 279], has submitted that the victim needs to be impleaded as party.
Learned counsel for the appellant seeks to implead the victim as respondent no. 2 in the array of parties.
Let the necessary addition be carried out in course of the day. Let notice be issued upon newly added respondent no.2 under ordinary process as well as through registered cover with A/D for which requisites etc. must be filed within one week.
Rule is made returnable by 18.10.2023.
