5/08.09.2023 This petition has been filed for proper investigation of
S.C/S.T. P.S. Case No.16 of 2023, pending before the learned Special
Judge cum A.J.C.-II, Ranchi.
2. Mr.Sarkhel, the learned counsel appearing on behalf of the
petitioner submits that the said case is not being properly investigated
and the unauthorized persons are trying to mislead the investigation.
3. The submission of Mr. Sarkhel, the learned counsel is being
opposed by the learned counsel appearing for the respondent State. It
appears that the matter is already pending before the learned court and
the petitioner is having the remedy of his grievance before the learned
court.
4. In view of above and considering that the petitioner is
having remedy in view of the judgment rendered in the Sakiri Vasu v.
State of Uttar Pradesh, (2008) 2 SCC 409 and in view of that, the
Court is not inclined to exercise its discretionary power under Article 226
of the Constitution of India.
5. Accordingly, this petition is being disposed of with liberty to
the petitioner to pursue his prayer before the learned court where the
matter is pending.
