Learned Counsel Mr. Akhouri Awinash Kumar on behalf
of the petitioner and on behalf of the State, learned A.P.P. are
present.
2. This Cr. Revision is directed against the Judgment dated
23.01.2023 passed by the Additional Judicial
Commissioner-VIII, Ranchi in Criminal Appeal No. 122 of 2022
whereby the learned lower court had partly allowed the appeal
and acquitted the petitioner for the offence under Section 341
and 504 of the Indian Penal Code while confirmed the
conviction for the charge under Section 498A and 323 of I.P.C.
passed by the trial court vide Judgment of conviction and
sentence dated 16.08.2022 in G.R.No.2884 of 2013, arising
out of Mandar P.S. Case No. 61 of 2013.
3. Admit.
4. Notice be issued to the O.P.No.2.
5. O.P.No.1-State is directed to ensure the service of notice
to O.P.No.2 through the Police Station concerned and to file
affidavit to that effect on or before the date fixed.
6. List on 06.11.2023 for disposal of I.A.No.8257 of 2023.
