At the very outset, learned Counsel for the petitioner has

submitted that he has mistakenly impleaded the O.P.No.2 and

wants to delete him and for the same seeks permission.

2. As prayed, deletion be made by the petitioner during the

course of the day.

3. Learned Counsel for the petitioner and on behalf of the

State, learned A.P.P. are present.

4. The instant Interlocutory Application is for condonation

of delay of 100 days in preferring this Cr. Revision against the

impugned Judgment.

5. The grounds shown in para 6, 7, 8 and 9 of the I.A. is

found sufficient.

6. The delay in preferring this Cr. Revision is hereby

condoned.

7. I.A.No. 9011 of 2023 stands disposed of.

The instant Cr. Revision is against the Judgment dated

10.02.2023 passed in Cr. Appeal No. 47 of 2015 whereby the

learned Appellate Court while dismissing the appeal confirmed

the Judgment of conviction and sentence dated 28.07.2015

passed by the learned Judicial Magistrate, Seraikella in

Adityapur P.S. Case No. 237 of 2012, corresponding to T.R.

No.121 of 2015 wherein holding guilty to the petitioner for the

offence under Sections 452 and 324 of I.P.C. sentenced to

undergo R.I. of 03 years under Section 452 of I.P.C. with fine

of Rs.500/- and further sentenced to undergo R.I. for 02 years

under Section 324 of I.P.C.

2. Admit.

3. Office is directed to call for the scanned copy of the

L.C.R.

4. List on 19.12.2023.
