7/ 24.11.2023 The petitioner has approached this Court for quashing of the order dated 17.8.2022 by which the representation of the petitioner pursuant to direction passed by this Court in W.P.(S) No. 4373 of 2015 regarding confirmation of his service as Dalpati has been rejected.

2. At the very outset, learned counsel appearing for the respondents submits that the issue involved in the present writ petition has been set at rest by the judgment delivered by the Division Bench of this Court in L.P.A. No. 49 of 2013, wherein the Division Bench has been pleased to hold that the State of Jharkhand has all powers, jurisdiction and authority not to give appointment or to keep their appointment in abeyance.

3. In view of submissions of the learned counsel for the parties and in view of the fact that the issue involved in this writ petition has been set at rest, this writ petition is accordingly dismissed.
