I.A. No.8884 of 2023
1. Learned counsel for the petitioner, learned counsel for the State and learned counsel for the opposite party No.2 are present.
2. The instant interlocutory application has been preferred to exempt the petitioner from surrender before the trial Court in compliance of the order dated 23.01.2023 passed by the learned J.M., 1st Class, Chaibasa in T.R. No.416 of 2023 arising out of Complaint Case No.193 of 2020, which was affirmed by the learned appellate Court vide order dated 20.07.2023 passed by the learned Sessions Judge, Chaibasa in Criminal Appeal No.50 of 2023.
3. The ground is shown that the compromise has arrived between the parties and it has been settled that the petitioner is to pay Rs.4,65,000/- to the opposite party No.2, the compromise is made Annexure-1 to this I.A.
4. In view of the above, I.A. No.8884 of 2023 is allowed.
5. The petitioner is exempted from surrender before the learned trial Court.
Cr. Revision No. 1242 of 2023
6. The instant Criminal Revision is against the judgment dated 20.07.2023 passed by the learned Sessions Judge, Chaibasa in Criminal Appeal No.50 of 2023, whereby dismissed the appeal and upheld the judgment of conviction and sentence dated 23.01.2023 passed by the learned J.M. 1st Class, Chaibasa in T.R. No.416 of 2023 arising out of Complaint Case No.193 of 2020.
7. The learned counsel for the petitioner and learned counsel for the opposite party No.2 have jointly submitted that the dispute between the parties has been settled and a compromise has arrived between them, which is Annexure-1 to the I.A. No.8884 of 2023. In view of the above, contended to dispose of this Criminal Revision.
8. Since the compromise has arrived between the parties, which is annexure of I.A. No.8884 of 2023. Accordingly, this Criminal Revision deserves to be disposed of.
9. This Criminal Revision stands disposed of in view of compromise, which is annexure of I.A. No.8884 of 2023. The impugned judgment passed by the learned trial Court, which was affirmed by the appellate Court are hereby set aside.
