The matter is being taken up through Video Conferencing. Learned counsel for the parties have no objection with it and submitted that audio and video qualities are good.

Order No.06/Dated: 3rd May, 2023 The instant Miscellaneous Appeal has been preferred against the judgment dated 02.01.2016 passed by the learned Principal District Judge, Lohardagga in Probate Case No. 01 of 2015, whereby the will dated 19.01.2018 executed by Kedar Nath Dubey in favour of respondent No.1, namely, Sanjeev Kumar Dubey @ Vicky, is decreed.

On instruction of Mr. Rajiv Ranjan Tiwary, learned counsel for the appellant, Mr. Ranjit Kumar Tiwary, learned counsel has submitted that the appellant-Janki Divi has preferred this Miscellaneous Appeal as she is claiming the property on the basis of transfer made by Kedar Nath Dubey and also on the ground that she herself was not impleaded as party in Probate Case No. 01 of 2015.

Mr. Ranjit Kumar Tiwary, learned counsel has further submitted that Mr. Rajiv Ranjan Tiwary, learned arguing counsel is out of station and he will argue this case on the next date, as such, this matter may be adjourned.

Mr. Ashok Kumar Pandey, learned counsel appearing on behalf of the respondent No.2, namely, Sita Devi has submitted that the matter may be listed in the next week.

On consideration of such submission, list this case on 08.05.2023. It is made clear that no further adjournment shall be granted.
