Order No.05 Date: 29.03.2023

The present writ petition has been filed for quashing the entire proceeding in connection with Misc. Case no.62 of 2020, initiated by the respondent no.4 particularly the order dated 25th February, 2020 and also for quashing all subsequent action taken pursuant to the said order passed by the respondent no.4. Further prayer has been made for declaring that no power or jurisdiction is vested with the respondent no.4 under any law to pass an order contrary to the judgment and decree passed in favour of the petitioner to divide or settle the land in favour of the respondent no.7.

Having heard learned counsel for the parties and keeping in view the stand taken in the counter affidavit filed on behalf of the State respondents particularly that on applications filed either by the petitioner or the respondent no.7, the proceedings under Section 144 Cr.P.C. have been initiated with respect to the land/structure in question from time to time, this Court is not inclined to entertain the present writ petition. Otherwise also, the impugned order dated 25th February, 2020 said to be passed under Section 144 Cr.P.C. has lost its statutory force in course of time.

The writ petition is, accordingly, dismissed.
