th Order No. 32/Dated: 17 March 2023 Mr. Rajesh Kumar, the learned counsel seeks two weeks' adjournment on the ground that Mr. Pran Pranay, the learned counsel for the respondent has suffered leg fracture.
Today is 32nd date of listing of this commercial appeal. Evidently, the proceedings in the present commercial appeal portray a very sad and grim picture at the Bar. There is an award in favour of the respondent and while so, it was the duty of the respondent to ensure that this commercial appeal is decided finally at the earliest.
We are making this observation for the reason that delay of each day would accrue interest in the event the award is affirmed by the Court.
While so, we make this order that even if this commercial appeal is dismissed, no interest shall accrue in favour of the respondent for the period of adjournment sought by the respondent even pursuant to the affirmation of the award dated 15th February 2015.
Post this matter on 6th April 2023.
Parties shall complete the pleadings. Parties shall also file their written submissions and produce compilation of the judgments, if any.
