2. This interlocutory application has been filed on behalf of the respondent nos. 4 and 5 to fix an early date of hearing in the present case. Learned counsel for the petitioners submits that the matter was earlier adjourned awaiting the judgment of this Court in Second Appeal No.185 of 2003. He submits that the Second Appeal has been dismissed on account of non-prosecution. Learned counsel submits that there is no impediment in deciding the present case. The second appeal was filed by the private respondent.

3. Considering the aforesaid submission, I.A. No.88 of 2013 is hereby allowed and the present case is directed to be posted under the heading for 'Final Disposal' on 13.04.2023.
