Versus
1. State of Jharkhand
2. Jharkhand Public Service Commission, Ranchi
3. Principal Secretary, Health, Medical Education & Family Welfare Depart. Govt. of Jharkhand, Ranchi
4. Secretary, Health, Medical Education & Family Welfare Depart. Govt. of Jharkhand, Ranchi .... .... Respondent(s)
------
CORAM : HON'BLE MR. JUSTICE ANANDA SEN.
------
For the Petitioner(s) : Mr. Amit Kumar Sinha, Advocate For the JPSC : M/s. Sanjoy Piprawall, Rakesh Ranjan & Prince Kr., Advocate
6/01.03.2023 Heard the parties.
2. The candidature of the petitioner was rejected on the ground that he has obtained 152 marks in his unreserved category. JPSC has stated that the last person recommended in the unreserved category had obtained 158. It is further their case that none who had obtained less than 158 marks or below has been recommended.
3. Since no one obtaining marks below 158 has been appointed in unreserved category, I find no illegality in not issuing the appointment letter to the petitioner. If the seats are vacant that should be carried over in terms of the judgment passed in LPA No. 308 of 2015.
4. Accordingly, the instant writ application stands dismissed.
