03/ 19.07.2023 Petitioners seek appointment to the post of Constable in Central Armed Police Forces.
It has been fairly submitted that though petitioners qualified in all the events of selection process but at the time of measurement, the height of petitioner No. 1 was measured as 169.5 cms. and the height of petitioner No. 2 was measured as 168 cms., whereas, the minimum eligible height is 170 cms. for male. Earlier petitioners appeared in the selection process but somehow they could not succeed in the said selection process. However, at that time, the height of petitioner No. 1 was measured as 170.1 cms and the height of petitioner No. 2 was measured as 170 cms. Learned counsel places heavy reliance to the judgment passed by the Hon'ble Delhi High Court in W.P.(C). No. 6664 of 2023 (Subrata Barman & Ors. Vs. Staff Selection Commission & Ors.) delivered on 18.05.2023.
Mr. Anil Kumar, learned ASGI submits that he needs to verify the matter and to file counter-affidavit.
As prayed, list this case after four weeks. Since petitioners have been able to demonstrate to this Court that earlier their height was measured as 170.1 cms. and 170 cms., respectively, let two posts be kept reserved till final disposal of the case.
