In view of the judgment reported in (2005) 1 SCC 568 (State of Orissa vs Debendra Nath Padhi), (2008) 2 SCC 561 (Onkar Nath Mishra and Ors. vs. State (NCT of Delhi) and Anr.), (1996) 9 SCC 1 (P.S. Rajya vs. State of Bihar), (2011) 3 SCC 581 (Radheshyam Kejriwal vs. State of West Bengal and Anr.) and (2020) 9 SCC 636 Ashoo Surendranath Tewari vs. Deputy Superintendent of Police, EOW, CBI and Anr., these above Cr. Revision No.283/2022 and Cr. Revision No.285/2022 will be heard.
Call for the scanned copies of the Lower Court Records from the learned court below.
Put up these cases after six weeks.
Till further order, the further proceeding in Misc. Criminal Application No.160 of 2022 and Misc. Criminal Application No.313 of 2022 in connection with R.C.09(A)/1997-D shall remain stayed so far as these petitioners are concerned.
