th Order No.3/ Dated: 14 July 2023 This Criminal Appeal has appeared at the instance of the Registry pursuant to the letter dated 20th March 2023 by which original records of SC Case No. 222 of 2009 has been requisitioned.

2. The Registry after keeping photocopy of entire lower Court records shall send the original records to the concerned Court of Judicial Magistrate, 1 st Class, Deoghar, through special messenger.

3. Mr. A.K. Kashyap, the learned senior counsel appears for the appellant who has been convicted and sentenced to RI for 10 years with fine of Rs. 10,000/- under section 376 of the Indian Penal Code.

4. Mr. Rajesh Kumar, the learned APP appears for the State of Jharkhand.

5. Mr. Pallav Kumar, the learned assisting counsel to Mr. A.K. Kashyap, the learned senior counsel and Mr. Rajesh Kumar, the learned APP shall prepare short synopsis and list of dates and file the same before next date of hearing.

6. Post this matter on 16th August 2023, under the heading "Final Disposal".

7. In view of the Full Bench judgment in "Tuklal Yadav v. State of Jharkhand" 2018 (4) JLJR 245, the Registry shall change the nomenclature of this Criminal Appeal and re-number the same accordingly.
