Heard learned counsel for the petitioners and learned counsel for the State as also learned counsel for opposite party No 2.
Learned counsel appearing on behalf of the petitioners seeks adjournment to take the instructions from the petitioners as to whether the terms and conditions are complied with by them or not and if not, how long will they take to comply the order dated 02.02.2023 by filing a supplementary affidavit.
On the other hand learned counsel appearing on behalf of opposite party No. 2 also seeks adjournment to file counter in this case in order to bring on record the cheque which was issued in terms of the settlement agreement by the petitioners and which have been dishonoured and therefore, the terms and conditions have been flagrantly violated by the petitioners.
As prayed for, let this case be adjourned.
In the meantime, let the present status of the case be called for from the concerned Court regarding the status of this case in the light of the judgment passed by the Hon'ble Supreme Court in the case of Asian Resurfacing of Road Agency Private Ltd. & Another Versus C.B.I. reported in (2018) 16 SCC 299.
The report must be received within four weeks from the date of receipt of this order.
