04/17.02.2023: The instant writ petition has been filed for a direction upon the respondents to open recommendation of the departmental promotion committee held on 20.09.2017 with respect to petitioner which was kept in sealed cover.

The admitted case of the petitioner is that the promotion of the petitioner was considered by the Departmental Promotion Committee in its meeting held on 20.09.2017 but the result was kept in sealed cover because at that time the petitioner was facing prosecution in Vigilance P.S. Case No. 04 of 2010, pending in the Court of Special Judge, Anti-Corruption Bureau, West Singhbhum, Chaibasa.

Thereafter, vide judgment 13.09.2022 the petitioner was acquitted. The judgment of acquittal has been brought on record.

Considering the aforesaid admitted position, there is no impediment in opening the sealed cover. Thus I direct the respondent to open the sealed cover within two weeks and act accordingly.

Accordingly, the instant writ petition is disposed of.
