I.A. No. 11040 of 2022 04/06.02.2023 I.A. No. 11040 of 2022 has been filed on behalf of the petitioner for grant of exemption to the petitioner from surrendering in the learned Court below without mentioning the provision of law.
2. Heard learned counsel for the petitioner and the learned counsel for the State.
3. It is submitted by the learned counsel for the petitioner that the judgments and order passed by the learned Court below are not sustainable in the eye of law. It is submitted that the petitioner is ready to pay the entire amount, if he is exempted from the surrendering in the learned Court below and as such, the petitioner may be exempted from surrendering in the Court below.
4. Learned counsel for the State has opposed the prayer of the petitioner from surrendering in the Court below.
5. From perusal of the impugned Judgments, it transpires that the petitioner is running racket in the name of providing jobs and he has cheated several person and had collected Rs.7,00,000/-. Accordingly, this Court is not inclined to exempt the petitioner from surrendering in the learned Court below.
6. Under the circumstances, I.A. No. 11040 of 2022 filed on behalf of the petitioner is rejected.
The petitioner is directed to surrender in the learned Court below within three weeks from today.
