1. The applicants have approached this Court for grant of privilege of anticipatory bail, in connection with Pakur Muffasil P.S. Case No.200 of 2023, registered for the offence under Rule 54 of the Jharkhand Minor Mineral Concession Rule, Sections 4(1)(A)/ 21 of the Mines and Mineral (Development and Regulation) Act and Rules 9/ 13 of the Jharkhand Mineral (Prevention of Illegal Mining Transportation and Storage) Rule, pending in the court of learned S.D.J.M., Pakur,

2. After some argument, learned counsel for the applicants seeks permission to withdraw the present anticipatory bail application with a liberty to approach the court below for grant of regular bail and to place all the judgments of the Hon'ble Apex Court relevant in the case.

3. Learned counsel for the State has no objection.

4. In view of the submission of the learned counsel for the applicant, the present anticipatory bail application stands dismissed as withdrawn with the aforesaid liberty.

5. However, if the applicant surrenders and prays for grant of regular bail, the court below is directed to consider the prayer for bail of the applicant considering the judgments of the Hon'ble Apex Court and the facts of the case, without being prejudiced by the order of withdrawal.
