08/ 28.08.2023 In all these writ petitions, the petitioners persons have challenged the appointment of private respondent No.7 of each writ petition.

It is specific case of the respondents-State that on the direction of this Court in W.P.(S) No.3165 of 2016, the respondents of the said writ petition after considering every aspects of the matter examined with the rules and in view of the fact that rules of game cannot be changed after the game is over, the appointment of private respondents have been made.

Mr. Arpan Mishra, learned counsel assisted by Ms. Aditee Dongrawat appearing on behalf of the petitioners places heavy reliance upon the judgment the Hon'ble Apex Court in the case of Pohla Singh @ Pohla Ram (D) By Lrs. & Ors. Vs. State of Punjab and Ors., reported in (2004) 6 SCC 126 and submits that since the affected persons-petitioners were not the party in the earlier writ petitions, the second writ petition on the same issue is maintainable.

Let notices be issued upon the private respondent No.7 (in all writ petitions) under registered post with A/D as well as under ordinary process, for which requisites etc. must be filed by the petitioners within two weeks.

As prayed for, put up these cases after six weeks.

The respondents may file counter-affidavit to the amended writ petition.
